Does the naked cowboy have a case?

NYC's beloved (!) Naked Cowboy of Times Square is suing CBS for allegedly ripping him off in its promos for the Bold and the Beautiful.

@uptowngirl Probably he doesn't need to pay a lawyer - he's done it often enough that he knows the schtick by heart. And as for time, what else does he have to do? This is a guy who spends his days in his underwear, I guess he needs to fill up the winter days somehow.

I've seen the Naked Cowboy! And I've got to say, I do rather wonder what he really does all day! Does he get money off tourists? Wandering around NY naked in December or January does not sound like my idea of a fun job.
